Required documents
- Certificate of registered trademark in the home country.
- Certificate of registration of the company or firm.
- Board resolution or board of directors minute to register the trademark in Nepal and regarding power of attorney.
Draft documents
- Application to register trademark, containing the applicant name and address, details of the potential trademark, class under NICE classification, and goods or services for which the trademark will be used.
- Power of Attorney, prescribing the authorised person who will be involved in the registration process on behalf of the company.
- Label of trademark, with four copies of the potential trademark measuring 8 cm by 8 cm.
Submission and preliminary examination
- Submit the application with supporting documents.
- Pay the application fee of Rs. 1,000.
- The Department of Industry, IP Section conducts preliminary examination.
- During preliminary examination, an application may be rejected if the potential trademark damages the reputation of a person or institution, contradicts public morality or national interest, affects the goodwill of an existing trademark, or is identical or similar to an already registered trademark.
Publication in IP Bulletin and opposition period
If the application qualifies, it is published in the IP Bulletin and the public or concerned institutions are invited to file opposition if they have objections.
An objection may be filed within 90 days of publication in the IP Bulletin.
Issuance of trademark certificate
If opposition is not filed after publication in the IP Bulletin, an application for issuance of the trademark registration certificate may be filed with the Department of Industry, IP Section, along with the registration fee of Rs. 5,000.
The Department of Industry, IP Section then issues the trademark registration certificate.
