Trademark Registration Process in Nepal

A guide to documents, application drafting, preliminary examination, IP Bulletin publication, opposition period, and certificate issuance for trademark registration in Nepal.

Required documents

  • Certificate of registration of the company or firm.
  • For a company, Memorandum of Association and Articles of Association.
  • PAN or VAT registration certificate.
  • Tax clearance certificate or extension approval document for tax clearance.
  • Annual compliance submission letter.
  • Industrial registration certificate or relevant business licence.
  • Citizenship document of the concerned persons.

Draft documents

  • Application to register trademark, containing the applicant name and address, trademark details, class under NICE classification, and the goods or services for which the trademark will be used.
  • Power of Attorney, prescribing the authorised person who will be involved in the registration process on behalf of the company.
  • Label of trademark, with four copies of the potential trademark measuring 8 cm by 8 cm.

Submission and preliminary examination

  • Submit the application with supporting documents.
  • Pay the application fee of Rs. 1,000.
  • The Department of Industry, IP Section conducts preliminary examination.
  • During preliminary examination, an application may be rejected if the potential trademark damages the reputation of a person or institution, contradicts public morality or national interest, affects the goodwill of an existing trademark, or is identical or similar to an already registered trademark.

Publication in IP Bulletin and opposition period

If the application qualifies, it is published in the IP Bulletin and the public or concerned institutions are invited to file opposition if they have objections.

An objection may be filed within 90 days of publication in the IP Bulletin.

Issuance of trademark certificate

If opposition is not filed after publication in the IP Bulletin, an application for issuance of the trademark registration certificate may be filed with the Department of Industry, IP Section, along with the registration fee of Rs. 5,000.

The Department of Industry, IP Section then issues the trademark registration certificate.
